Final Rule on Subcontracting in Effect August 15, 2013

In accordance with provisions of the 2010 Small Business Jobs Act, the SBA has issued a final rule regarding prime contractor reporting and contracting officer oversight with respect to subcontracting plans.

The rule, which goes into effect on August 15th, requires primes to notify contracting officers when changes are made to the subcontracting plan or if payments to subcontractors are late.  Contracting officers will be required to monitor subcontracting plans more closely.  Changes are also made to clarify data reporting requirements, amend thresholds for subcontracting reporting and provide updates on the use of the electronic subcontracting reporting system (eSRS).
